TOURS TERMS & CONDITIONS
The Reservation
A minimum deposit of 20% of the total price is required at the time of booking, and the balance no later than 40 days prior to departure of the tour. For overseas booking and non-residence of Tanzania, payments should be in the US Dollars or UK Sterling Pound. Residents pay in local currency at the rate or exchange applicable at the time of payment. The company reserves the right to withhold all or part of the service (at its sole discretion) if any payment is not received in accordance with the above conditions.
Late Booking
Full payment is due at the time of booking for reservations made within 40 days prior to the commencement of tours.
Modification of Tour
If you choose to modify the arrangements after the commencement of the tour i.e. Change accommodation or the duration of your stay, the company can accept no liability for any loss or additional expense incurred and no refund will be made.
Cancellation of Tour
Should you wish to cancel your confirmed booking, you must advise the company in writing.
Reservations that are cancelled, reduced in length of stay or reduced in numbers (hereinafter collectively called a CANCELLATION) are subject to Cancellation and No Show fees if cancelled within 30 days of the arrival date:
* 40 days to 22 days prior to arrival: 25%
* 21 days to 15 days prior to arrival: 30%
* 14 days to 07 days prior to arrival: 50%
* 06 days to 03 days prior to arrival: 65%
* 02 days to 01 days prior to arrival: 100%
Within 48 hours and after commencement of holiday: 100%. Once the holiday has commenced no refund will be made. The figures expressed are percentage of the total tour price.
Tour leader:
1 Bonafide tour leader after every 15 paying clients up to a maximum of 4 - will get free accommodation in half twin (i.e. sharing room). If staying in single, single room supplement will be charged accordingly. The tour leader is free only on accommodation, but other extras i.e. flights and all optional services are charged accordingly.
Drinks:
These are not included in our costs although we do provide complementary mineral water in vehicles during your safari.
Liability
We act as agent for hotels, transportation services and facilities provided by other parties, firms or corporations and cannot be held responsible for delays, loss, damage, injury or accident, change of itineraries which may occur through the negligence of any individual or company entrusted with such service.
* The rates quoted are subject to change without prior warning or should there be any increases in Park Fees, Fuel, or Vat, Third Party Services or any other circumstances beyond our control in the countries featured in this quote/booking.
* We cannot be held responsible should airlines discontinue flights on certain routings or change scheduled timetables resulting in missed connections etc. Should an amendment in a routing or itinerary be necessary we will requote accordingly.
* Please advise your clients to take precautions against malaria prior to the commencement of their holiday. We recommend they contact their pharmacist for advice as to which prophylactic is recommended.
Force Majeure
The Company cannot accept any liability or pay any compensation in respect to delays or lack of performance affected by 'force majeure'.
Force Majeure means any event which the Company has no control over and even in circumstances where all due care was taken the event could not have been avoided or foreseen. This includes events such as war, or threat of war, riot, civil strife, terrorist activity, industrial dispute, natural disaster, adverse weather conditions, fire and all similar events outside the Company's control.
Insurance
You are strongly advised to take out adequate insurance against all risks for an adequate sum. The Company does not undertake to provide medical care (except to call in the flying doctors transfer service in Kenya and Tanzania) and the Company does not accept liability for any inadequate care provided.
Children Policy
Children under the age of 12 sharing a room with two adults generally pay 50% - 70% of the rate quoted except on air, rail, safaris, adventure programmes or balloon safaris. Children under 7 are not permitted in any tree hotels and most tented camps. Some wildlife lodges and tented camps accommodate a maximum of 2 persons. Other restrictions may apply from time to time. Children rates are available on request.
Itineraries
Demand for safaris can be high and may lead to shortage of lodge/hotel accommodation. All bookings will be confirmed, but no occasions changes may be necessary. Hotels/Lodges/camps, here specifically named are given as an indication of the category and rooms may be reserved at similar lodges/hotels/camps. We undertake to advise you of any changes known to us prior to departure, but the possibility of change without notice, must be acceptable when booking. Where ever possible we book rooms with private baths showers throughout on the basis of two persons sharing a double room. Single rooms are available at supplementary cost but neither single rooms nor rooms with private bath/shower can be guaranteed.
Safari minibuses cars, four wheel drive vehicles or coaches will be provided according to the route and number of participants. The right is reserved to employ the services of subcontractors. English speaking chauffer/guides are provided. Occasional mechanical problems, changes of lodge or adverse road conditions may in turn lead to a change of routing or game viewing without prior notice being given. We reserve the right to offer substitutes of equal value or to cancel the operation of any tour. In practice, very few itineraries are affected but a little flexibility on your part will ensure the tour is unique and rewarding.

Whilst every effort has been made to ensure the accuracy of this website/e-brochure at the time of printing, regrettably errors do occasionally occur. You must therefore check all details of your holiday booking with your travel agent or supplier at the time of presentation.
The company cannot therefore accept responsibility for any information not contained in this brochure, being confirmed verbally by its staff or representatives unless subsequently reconfirmed in writing by the company.
Liability
1) The company is insured against legal liabilities arising from injuries which might be received by passengers while inside vehicles. You are however strongly advised to takeout your own insurance against the risk inherent in traveling in enveloped country especially as there may be time when your tour visits remote regions without means of rapid evacuation or medical facilities. Please remember that your supplier does not undertake to provide such assistance at its expense hence our strong recommendation to provide such assistance to cover such eventualities.
2) The company and its agents act only as agents of the passenger in all the matters relating to hotel accommodation, sightseeing, tour and transport whether by aircraft, rail, motor coach, ship, boat or any matter howsoever except when the passenger is being carried in transport owned by the Company.
3) The company’s obligations apply to those services, which they agree to provide on your behalf. We cannot be held liable for any third party arrangements you arrange in conjunction on your own. For example we cannot be held liable if you miss your tour departure because you fail to arrive at the departure point at the agreed time.
4) The Company’s liability to passengers carried in its own vehicles is governed by the laws of the respective country in which services are provided and no other country, and all claims are subject to the jurisdiction of the courts of the respective country in which the services were provided.
5) The company reserves the right to employ subcontractors to carry out all or part of the services agreed to be supplied and in the event of such right the terms to the clause relating to the company’s liability shall apply.
6) Whilst every care is taken, the company cannot be held responsible for the loss or damage. It is therefore advisable to affect separate baggage insurance.
7) In the event that a claim is made against the travel agent or tour operator in respect of any loss or damage occasioned by the breach of contract, negligence or other fault of the company, the company shall be liable to indemnity the Travel Agent or Tour Operator (as the case may be) in the courts of the country in which services were provided if the Travel Agent or Tour Operator (as the case may be) had submitted jurisdiction in the said courts.
8) In respect of any such claim mentioned in sub clause (a) of this clause, the company shall be under no liability expressly assumed in this clause.
9) For the purpose of this clause, the company shall be deemed to include its servants and agents and shall be deemed to contract on behalf of such servant and agent.
10) Law: The Company's contract will be governed by and constructed in accordance with the law of Kenya. Accordingly each party irrevocably submits to the jurisdiction of the Kenyan courts to settle any dispute or matter arising under this contract.
